Credit Card Debt Statute Of Limitations

Each state has a different law when it comes to the credit card debt statute of limitations.  These range from three to ten years with some states having even longer credit card statute of limitations.  These laws are not in place to protect to the credit card company, but the consumer.  What this means is that credit card debt collection can not take steps to sue over credit card debt once the statute of limitations has passed.  

This does not mean that you do not have to pay off your debt.  A debt collection agency can still attempt to collect on the credit card debt.  This simply means that when credit card debt collections companies purchase your credit card debt, they can not legally sue you for the debt if the statute of limitations has passed.

Many credit card companies sell old paper, or debts to collection agencies for fractions of a penny on the dollar.  They sell a lot of this old debt off at once to at least recoup some of the monies lost from the lack of these debts being paid.  The collection agency will then try to collect on the original amount of the debt.  When you pay, the collection agency keeps the money to pay for the debt that they purchased.

While debt collection agencies can not harass you or go beyond the bounds of the Fair Debt Collection Practices Act, they are well within their rights to collect on the debt.  Consumers still owe the debt whether two months or twenty years have passed.  If you borrow money from a family member or friend, you would still owe it no matter how much time has passed.  The same holds true with credit card debt.

Many people feel that when the credit card debt statute of limitations has passed that the debt will be wiped off their credit report.  This is not true.  The debt is still owed, but the collection agencies can not sue.  That is the only change the statute brings about.  Since many collection agencies buy your debt at a reduced rate, you will be able to settle your account for much less than it is worth through a collection agency.

Getting Rid Of Credit Card Debt

If you have become like many who are in debt, most of that debt will probably be credit card debt.  You may have been wondering what you need to do to help you in getting rid of credit card debt.  Bankruptcy is a solution, but many would rather pay credit card debt off and be in a good credit standing.  This can be hard to do once you are in debt.

It may be nearly impossible to pay credit card debt and still maintain a good credit rating.  There is, however, one way to do this if you are a homeowner in good standing.  You can take a second mortgage on your home and use those funds to pay credit card debt.  This will enable you to pay off your credit cards without losing your credit rating.

Another way of getting rid of credit card debt is to settle your credit card accounts with the account holders.  This way will do some damage to your credit rating, but it will not be as bad as the outstanding debt would be if it is sent to collections.  You will need to contact each institution that has given you an open line of credit by way of a credit card.

Speak to the company and try to settle down your account.  This means that you will cut up the credit card and the lien holder will close any available balance you may have.  You will not be able to use the card again.  Typically, a good portion of the interest will be removed and you will be paying strictly on the principle balance.  Some companies will not take payments on this type of settlement, but will want the entire amount at the time that the settlement has been decided upon.

In order to pay off a settlement, you may want to get a consolidation loan from your bank.  You will be getting rid of credit card debt and only have one payment to make each month and typically with a much lower interest rate that will be more manageble.
